Practice Area: Eminent Domain/Condemnation Matters
  • Our firm recently completed representation of property owners in the largest eminent domain purchase of private land in Gwinnett County (consisting of over 58 acres of contiguous property). The matter was resolved to the satisfaction of our clients, the property owners, after over one and a half years of negotiations. The issues involved included valuations of raw land, business valuations, Will and estate issues, and interpretation of the new laws regarding eminent domain.
  • Under current Georgia law, property owners have many more statutory protections against taking of private property by municipalities, counties, or state government entities. Our firm can guide you through the maze of offers, delays and uncertainties that face many property owners when faced with a proposal – then – threat of a government acquisition of their property.
  • Our firm experience in understanding property appraisal techniques is based on prior condemnation matters and over fifteen years of handling property tax appeals.
  • Our firm specializes in the negotiation techniques that are more likely to result in a mutually acceptable privately purchase of the property in question.
  • If disputes cannot be resolved by private negotiations or if you as the property owner believe the proposed acquisition by a government authority is unlawful we will represent your positions in the condemnation proceeding or by a separate civil action to restrain or prevent the proposed taking of property.
  • Our firm fees for this work are flexible and can be based on hourly work or possibly based on a percentage of the proposed acquisition.
